Frequently asked questions

Medical office: your questions

Can a medical practice operate in any office building?

Not always. Municipal zoning ordinances often treat medical offices differently from general or professional offices, with their own parking and use requirements. Confirm the use with the zoning officer before you sign, and if the use is not permitted, a variance from the zoning board of adjustment may be required.

Do accessibility laws apply to medical offices?

Yes. Under the Americans with Disabilities Act, the professional office of a health care provider is a place of public accommodation. Accessibility should be part of evaluating parking, entrances, restrooms, exam rooms and routes through the space, and your lease should state who is responsible for which accessibility work.

What permits are needed to build out a medical office?

Construction permits are generally required for alterations under New Jersey’s Uniform Construction Code, and if the space is changing use, a new certificate of occupancy must be issued before it is occupied for the new use. Build the permit and inspection timeline into your lease commencement and rent start dates.

Should my practice lease or buy its space?

Leasing preserves capital and flexibility; buying can provide control and long-term stability. Owner-occupants may be able to use SBA 504 or 7(a) financing when the practice occupies at least 51% of an existing building. I help you compare the total cost and flexibility of both paths for your practice plan.

What lease terms matter most for a medical practice?

Term and renewal options that match your practice plan, a tenant improvement allowance for build-out, permitted use language that covers your specialty, after-hours HVAC and access, signage, parking, assignment rights if you sell or merge the practice, and any exclusive-use protection. Your attorney reviews the final lease.

Can you help me buy a medical office condominium?

Yes. With an office condominium you are buying a unit plus a share of common elements, so we review the association’s budget, rules on medical use, reserves and assessments alongside the unit itself.

How do you keep a practice relocation confidential?

I share your name and practice details only with your permission, tour discreetly, and coordinate with your attorney and lender on timing so staff and patients hear about a move when you are ready.

What if I am selling a practice that owns its building?

Then the business sale and the real estate sale move together. The buyer typically must file a bulk sale notice with the Division of Taxation at least 10 business days before closing, and the property needs its own disclosures and due diligence. I coordinate the real estate side with your attorney and accountant.
