Frequently asked questions

Selling in New Jersey: your questions

What disclosures do I have to provide when selling in New Jersey?

Since a 2024 change in New Jersey law, sellers of residential property must complete questions 1 through 108 of the Property Condition Disclosure Statement before the buyer becomes obligated under a contract. All sellers of real property, residential and non-residential, must also complete the Flood Risk Addendum about FEMA flood zones and any flooding they know about. Sellers are also obligated to disclose known material defects even if a form does not ask about them.

Do I need a smoke detector or certificate of occupancy inspection to sell?

Before a one- or two-family or attached single-family home is sold, the owner must obtain a certificate showing compliance with smoke alarm and carbon monoxide alarm requirements from the local enforcing agency. Where a town has its own resale inspection or certificate of occupancy process, that process applies and must confirm the alarm requirements. The certificate is not transferable, and a new application is required if the sale does not happen within six months, so ask your town early about its exact requirements.

What transfer taxes and fees does a New Jersey seller pay?

The State imposes a Realty Transfer Fee on the seller when the deed is recorded, calculated on the sale price, with some exemptions and reduced rates. On sales over $1 million, a Graduated Percent Fee also applies to the seller for deeds submitted on or after July 10, 2025, from 1% of the total price up to 3.5% above $3.5 million for residential and certain other property classes. Your attorney or title company will confirm the exact amounts on your closing statement.

I live outside New Jersey. Is there an exit tax when I sell?

Nonresident individuals, estates and trusts that sell New Jersey real property generally must make an estimated Gross Income Tax payment at or before closing, unless an exemption or waiver applies. The payment is the greater of 2% of the sale price or the gain multiplied by the highest New Jersey income tax rate, and it is due whether or not there is a gain. It is an estimate credited against your New Jersey tax return, so speak with your tax professional before you list.

When does an accepted offer become binding?

For homes with one to four units, a contract prepared by real estate licensees becomes binding after a three-business-day attorney review period, unless an attorney for the buyer or seller disapproves it within that time. The days are counted from delivery of the signed contract to both parties, excluding weekends and legal holidays.

How do you decide on a listing price?

I prepare a comparative market analysis using recent comparable sales, homes currently competing for the same buyers, and the condition, location and features of your home. We then agree a pricing strategy that fits your timeline. The goal is a price that draws strong interest early, backed by data you can see.

Should I renovate or stage before listing?

Usually the best return comes from preparation rather than major renovation: repairs, decluttering, cleaning, light cosmetic updates and staging guidance. I give you a prioritized list so you spend only where it is likely to matter to buyers. Larger projects may need permits, so ask before starting.

How long does it take to sell a home?

It depends on pricing, preparation, the property type and current buyer demand, so I won’t quote a fixed number. The main stages are preparation, marketing and showings, offer and attorney review, inspections and the buyer’s mortgage approval, and closing. At the start I give you a timeline built around your goals and adjust it as the market responds.

How is a real estate commission set in New Jersey?

Broker compensation is fully negotiable and not set by law. New Jersey requires the amount and how it is calculated to be written in your brokerage services agreement, and listing agreements may not contain a pre-printed or prescribed commission rate. We discuss compensation openly before you sign anything.

Do bulk sale rules apply when I sell a commercial or rental property?

Often, yes. When business assets, including income-producing real property, are sold outside the ordinary course of business, the buyer must notify the New Jersey Division of Taxation on Form C-9600 at least 10 business days before closing so any of the seller’s state tax obligations can be addressed. One- and two-family homes owned by individuals, estates or trusts are not subject to bulk sale notification, even if they are rented.
